SunPower Capital, LLC, and its servicing affiliate, SunPower Capital Services, LLC (collectively, "SunPower Capital," "we," "us," "our") respect your privacy. This Privacy Policy ("Policy") is designed to inform you about the types of Personal Information that SunPower Capital may collect or receive about you when you request information about or apply for a solar panel system lease or other form of financing through or with us. It also explains how we use and share such Personal Information, the choices available to you, and how you can contact us and exercise your legal rights.
SunPower Capital is a wholly-owned subsidiary of SunPower Corporation. For more general information about how SunPower Corporation and its affiliates use your Personal Information, please review SunPower Corporation's Privacy Policy. This Policy, and the SunPower Corporation Privacy Policy, are incorporated into our Terms of Use Agreement, which applies when you use or visit any SunPower Corporation website, available at or from www.sunpower.com, as well as any mobile application or digital services owned by SunPower Corporation or its affiliates (collectively, our "Digital Platforms").
WE MAY CHANGE THIS POLICY FROM TIME TO TIME. THE "LAST UPDATED" DATE AT THE TOP OF THIS PAGE WILL LET YOU KNOW WHEN THIS POLICY WAS LAST UPDATED AND INCLUDE INFORMATION ABOUT ANY EFFECTIVE DATE, IF APPLICABLE. Any changes to this Policy will become effective on the date on which we post the revised Policy, unless otherwise specifically noted in the legend. THE INFORMATION WE COLLECT
Categories of Personal Information we Collect
When you request information about or apply for a solar panel system financing option, we collect information about you, including Personal Information. Personal Information means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or as defined by applicable law.
The types of Personal Information we collect depends on the product and service that you have with us. Within the last twelve (12) months, we may have collected the following categories of Personal Information from or about you:
Contact information (e.g., name, address, zip code, telephone number, email address of the owners or co-owners of the dwelling on which a SunPower system is sought);
Proof of identity (e.g., Social Security Number, National Identity Number, Driver's License number/document, Passport number or document);
Financial details (e.g., your credit score and history; account balances and payment history; credit card or bank account information; income and tax information);
Employment details (e.g., employer, position, employment verification);
Energy usage (e.g., utility bill); and
Your product purchase history.
How We Obtain Information from You
We collect Personal Information directly from you in a variety of ways:
Application: If you submit an application to lease a solar product from us or finance a product through an independent entity, we will collect Personal Information from you, such as your contact information, proof of identity, financial details, employment details, and energy usage. We use this Personal Information to assess your eligibility for the financial product applied for and to otherwise process your application.
Online account: If you sign up or use a SunPower application or service, we collect the Personal Information you provide to create a profile, account, collect payment, or to receive information about the performance of your system or SunPower products. This may include your contact information, financial details, or energy usage.
Payments: If you make a payment to us, either directly or through one of our approved service providers, we collect information necessary to process the transaction and validate your identity. This may include your contact information and financial details. When you use a SunPower Capital approved service provider to make a payment, your use of the service is subject to that service provider's Terms and Conditions and Privacy Notice.
Communications with SunPower Capital: When you contact SunPower Capital by telephone or e-mail, we collect your contact information and any other Personal Information you choose to provide us. We use your Personal Information in order to provide information and assistance regarding our solar panel financing options and related services, and to service the issue that you are raising in connection with the call, e.g. to service any questions you may have about your lease, payments or account history.
Information we Collect from Third Parties
Throughout the course of its relationship with you, SunPower Capital may receive Personal Information from third parties in order to provide you information about our solar financing products, process your application for a financing product, or to otherwise manage your account with us. These third parties include:
Third Parties with whom we have a relationship: SunPower Capital may receive your Personal Information, such as your contact information and financial details from third parties with whom we have a relationship, including our authorized independent dealers, home builders, and other service providers that assist us with providing lease or financing products to you, including in connection with the underwriting, e.g. approval of those products or the servicing of those products. This information is collected from third parties: (1) to determine whether you are interested in and qualify for SunPower solar panel financing options and whether that option is right for you; and (2) to maintain your relationship with SunPower Capital, which may include to transfer or assign a lease in connection with the sale of your home.
Third Parties who you authorize to provide us information: Third parties from which SunPower Capital may receive Personal Information may include our escrow agents, mortgage brokers, real estate agents, your energy company/provider, or individuals authorized to act on your behalf, including pursuant to a Power of Attorney, whom you authorize to provide information to us on your behalf, including in connection with the sale of your home, the transfer of your lease, or buy-out of your lease with us.
Financial institutions and consumer reporting agencies: In accordance with applicable law, we may receive your Personal Information, such as your contact information and financial details, from third-party financial institutions and credit reporting agencies who assist us in processing your Personal Information and assessing your eligibility for a solar panel lease/financing product or service. We use consumer reports in accordance with applicable laws.
Co-applicants: We may also collect your Personal Information from co-applicants or co-owners of a dwelling associated with your installation, which may include your contact information, proof of identity, financial details, employment details, and energy usage.
HOW WE USE YOUR PERSONAL INFORMATION
We use the Personal Information set out in Section 1A to facilitate the business relationship with you, to comply with our legal and financial obligations, and to pursue our legitimate business interests, which include the business purposes set out below:
Send correspondences, including electronic communications;
Create and maintain your account;
Create and manage an online account; and
Create and manage lease relationships or other forms of financing.
We may use your Personal Information set out in Section 1A for the following commercial purposes:
Provide you with information regarding our solar products and financing services (marketing).
For SunPower Capital's own business purposes, e.g. to report the closing of leases to Business Partners or Financial Institutions, to secure financing for our lease portfolio, or to sell leases, individually or in groups, as allowed under our contract with you.
To secure financing commitments for SunPower's residential solar lease program, which may require the sale of your lease, as allowed under our contracts with you.
To provide services related to your lease, which may include, for example, notifying relevant Business Partners or Financial Institutions of service requests or other material events regarding your lease (e.g., the sale of your home).
HOW WE DISCLOSE YOUR PERSONAL INFORMATION
We may share your Personal Information with trusted third parties or in other instances, including where required by law. We will use contractual or other means to protect Personal Information disclosed to third parties where required to ensure that the recipient keeps the Personal Information confidential and does not use it for any other purpose except performing the services. This includes limiting access to only those individuals who require access in order to complete the purpose for which the Personal Information was collected by the third party.
In the last twelve (12) months, we may have disclosed your Personal Information set out in Section 1A above with the following categories of third parties:
Affiliated Entities: Companies related by common ownership or control, financial and/or nonfinancial companies, joint ventures or parent company, or subsidiaries of SunPower Capital ("Affiliates");
Business Partners: Independent distributors, dealers and installers, home builders, agents, companies that perform services for us (e.g. debt collection services, IT-related services) or companies or entities to which we report lease or sales consummation or closing data ("Non-Affiliated Entities");
Financial Institutions: Financial institutions, or their organic subsidiaries, who finance the leases and other forms of financing, and other entities who help manage the leases and other forms of financing, send you notice of payments due, and reminders of past due payments ("Financial Institutions");
Credit Reporting Agencies: Credit Reporting Agencies (regarding late payments, missed payments or other defaults on your account); and
Government: Government and law enforcement officials, agencies or private parties to enforce our rights, respond to legal requests made in compliance with applicable law (subpoena, search warrant, or court order), or in connection with governmental audits or other reporting requirements, e.g. escheatment or unclaimed property reporting obligations.
We disclose Personal Information to such third parties for:
Our everyday business purposes in order to process your transactions, which includes to report the closing of a transaction, and maintain your account(s);
Our compliance with applicable law, to respond to court orders and legal investigations, or report to credit bureaus;
Our marketing purposes to offer our products and services to you;
Affiliates' everyday business purposes regarding your transactions and experiences; and
Financial Institutions' purposes, in order to provide jointly with SunPower Capital and its Affiliates, administrative services in conjunction with the distribution of the solar panels under joint venture agreement.
We will not share Personal Information we collect with Non-Affiliated Entities except as permitted by applicable law, such as to process your transaction or to maintain your account, or with your consent.

YOUR RIGHTS TO YOUR PERSONAL INFORMATION
Access, Questions, or Concerns
You may have the right to correct, delete, or update your Personal Information. SunPower Capital reserves the right to limit this right where exceptions apply or it may do so under law. Please note, depending on the right you seek to exercise, and the manner in which you seek to do so, e.g. directly or on behalf of someone else, SunPower Capital may seek additional documentation to validate your identity and the validity of the information you wish to update.

California Residents
If you are a resident of California, the California Consumer Privacy Act ("CCPA") (Civil Code § 1798.100) provides you with specific rights regarding your Personal Information. These include:
Information about Collection, Sale or Disclosure: You have the right to be informed of the categories of Personal Information that we collect about you, the categories of sources from which the Personal Information was collected, the business or commercial purposes for which the Personal Information is used, disclosed, or sold, and the categories of third parties with whom we share the Personal Information, as set forth in this Policy.
Access to Specific Information: You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. This includes the categories of Personal Information we collected about you; the categories of sources for the Personal Information we collected about you; our business or commercial purpose for collecting or selling that Personal Information; the categories of third parties with whom we share that Personal Information; and the specific pieces of Personal Information we collected about you. If we sold or disclosed your Personal Information for a business purpose, you have the right to request two separate lists disclosing the categories of Personal Information that we sold about you and to whom; and the categories of Personal Information that we disclosed about you for a business purpose. You have the right to receive the Personal Information, which you have provided to us, in a portable, and to the extent technically feasible, a readily useable format. SUNPOWER CAPITAL DOES NOT SELL PERSONAL INFORMATION ABOUT YOU.
Deletion Request Rights: You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions.
Personal Information Sales Opt-Out Rights: You have the right to opt out of the sale of your Personal Information. SUNPOWER CAPITAL DOES NOT SELL PERSONAL INFORMATION ABOUT YOU.
Non-Discrimination: Unless permitted by applicable law, we will not discriminate against you for exercising any of your privacy rights under CCPA or applicable law, including by, but not limited to:
Denying you goods or services;
Charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
Providing you a different level of quality of goods or services; or
Suggesting that you will receive a different price or rate for goods or services or a different level of quality of goods or services.
Exercising Your Rights - Only you or an authorized agent may make a verifiable consumer request related to your Personal Information. To exercise your rights, please submit SunPower's Consumer Privacy Right Request form, or by using the link on our website, which will be reviewed and responded to by SunPower's Privacy Review Team. You may also submit your request telephonically by calling SunPower at 800-786-7693, and a member of our Privacy Review Team will handle your request.
Designating a Third-Party to Act on Your Behalf - In order to designate a third party to act on your behalf, that person must be registered with the California Secretary of State and must have valid written evidence of authority from you to act on your behalf, e.g. a validly executed Power of Attorney or some other written, notarized documentation that they can provide to SunPower. Absent such documentation, SunPower reserves the right to refuse to comply with third-party requests for information.
Verifying Your Requests - During the verification process, depending on the nature of your request, e.g. whether you are seeking access to information versus deleting information, we will first seek to verify your identity against known information in our environment, such as your name, e-mail address, and telephone. Upon receiving your request, we may also contact you via a known email, telephone and/or other secured communication channel to verify your identity. In certain instances, e.g. a mismatch against known information or where you are seeking information on behalf of another person with authorization, we may seek additional verification from you, which may be in the form of you providing a copy of a valid, government-issued identification or a notarized attestation.
DATA SECURITY
We protect your Personal Information by restricting employee, vendor and third-party access to your Personal Information on a need-to-know basis and only as necessary to provide you with the products and services you request or to otherwise fulfill your reasonable expectations with us. While we cannot warrant the security of any Personal Information you send to us because no information security program can guarantee complete protection, SunPower applies physical, electronic and procedural safeguards to maximize our ability to protect your Personal Information from unauthorized disclosure, consistent with applicable federal, state, and industry standards.
